        The Marine Corps League (MCL) follows a strict, hierarchical flow of governance where lower-level bylaws must always conform to higher-level authorities.

 

Hierarchy of Authority

  1. National Bylaws (NBL): The supreme governing law of the entire organization, supplemented by the National Administrative Procedures (NAP).

  2. Department Bylaws (DBL): State-level rules that must strictly comply with all National Bylaws and policies.

  3. Detachment Bylaws: Local/unit-level rules that must conform to both National and Department bylaws, as well as local, state, and national laws.

 

Flow of Creation, Ratification, and Approval

  1. Drafting: A local Detachment drafts or updates its local bylaws using the standard structure (covering name, membership, officers, elections, meetings, committees, and finances).

  2. Membership Review & Ratification: The completed draft is presented to the local detachment membership for review, discussion, and revision during a scheduled meeting. A majority vote of the members and officers present is required for approval.

  3. Department Judge Advocate Review: Immediately after local approval, the detachment submits a copy of the new bylaws to the Department Judge Advocate for formal review.

  4. Compliance Check: The Department Judge Advocate ensures the local rules do not conflict with Department or National bylaws. If changes are needed to achieve compliance, the detachment must adjust the wording accordingly.
